The person planting the hidden recording device has engineered the situation and conversation to create a reaction / comment, thereby obtaining irrefutable evidence of a colleague using racist, homophobic, transphobic, etc comments.

Although it can be argued that the person planting the clandestine device should not be doing so in the first place, the fact that an employee has made the comments seems to outweigh the deployment of the recording device, and the focus of management is on the inappropriate comments and dealing with that.
